Using Povlet
These Terms of Service are an agreement between you and Povlet (“we,” “us,” or “our”) governing your use of the Povlet app and website. By creating an account or using the service, you agree to these terms. If you do not agree, do not use the service.
Our Privacy Policy explains how we handle personal information. These terms do not replace any rights or protections that applicable law gives you.
Age and account requirements
You must be at least 13 years old and meet any higher minimum age or parental-consent requirements where you live. If you are below the age at which you can enter this agreement on your own, a parent or legal guardian must review and agree to these terms with you, where local law permits your use. Nobody under 13 may use Povlet.
Use an email address or sign-in account that you control. Keep your account details reasonably accurate and protect your sign-in links, email codes, device, and invitation codes. Tell us if you believe someone has accessed your account without permission. Do not impersonate someone else or use another person’s account without authorization.
Your shared journal
Povlet lets you connect with one person at a time and share everyday photos as paired Moments. You can also add notes and reactions, revisit memories, and use available reminder, widget, and export features. Features and availability may change.
Only connect with someone you intend to share with. Once both photos are submitted, they become available to the pair. An incomplete photo is shared only if its owner chooses the available one-sided release option. The reveal animation is a presentation feature, not an additional access-control or encryption layer.
A recipient may save or screenshot content. A paired postcard may include both people’s photos: obtain the other person’s permission before sharing their photo outside Povlet, and do not assume that in-app sharing gives you permission to publish it.
Reminders, notifications, uploads, and background processing depend on network connectivity, device settings, and service availability. They may be delayed or unavailable. Povlet is not an emergency, safety-monitoring, or guaranteed-delivery service.
Your content and permissions
You retain ownership of your photos, notes, and other content. You are responsible for what you submit and for having the rights, permissions, and consents needed to share it, including where it identifies another person.
You give Povlet a limited, non-exclusive, worldwide, royalty-free permission to host, store, process, resize, copy, and transmit your content only as needed to operate the features you choose, deliver it to your connected person, handle support or safety issues, and comply with law. Service providers may perform these tasks for us. This is not permission to sell your private photos or use them in public advertising.
This permission lasts while needed for those purposes and the retention and deletion processes described in our Privacy Policy. It does not give us ownership of your content or remove rights that cannot legally be waived.
Keep it respectful and lawful
You must not use Povlet to:
- Harass, stalk, threaten, exploit, impersonate, or repeatedly contact someone who does not want contact.
- Share illegal content, child sexual abuse material, non-consensual intimate images, pornography, or content promoting violence or hatred.
- Violate someone’s privacy, intellectual-property rights, or other legal rights.
- Guess or harvest invitation codes, bypass access controls, interfere with the service, distribute malware, or collect other users’ information without authorization.
- Send spam, automate abusive activity, or use the service in a way that breaches applicable law.
You can report a concern and block a connection in the app, or contact surafelpovlet@gmail.com. We may investigate reports, restrict access, remove content, or suspend an account where reasonably necessary to address violations, protect people or the service, or comply with law. You can contact us if you believe an action was taken in error. For immediate danger, contact local emergency services rather than relying on Povlet.
Leaving, blocking, and deleting
You may stop using Povlet at any time. Leaving a connection can leave previously shared memories available in read-only journals. Hiding a Moment changes your view; it does not delete the other person’s content or saved copies.
You can remove your own photo contributions, block a connection, or initiate account deletion from Us → Your account → Delete my account. File and account cleanup can take additional time because it runs in the background. Your request does not delete photos owned by another person, and copies or links already obtained may remain outside our control. The Privacy Policy explains retention and offline-device limitations.
We may suspend or end access for serious or repeated violations, a security threat, or a legal requirement. Where appropriate and legally permitted, we will provide notice and a way to contact us about the decision. Clauses that reasonably need to continue after account closure, including content rights during permitted retention, legal responsibilities, and dispute provisions, remain effective.
Availability, changes, and costs
We aim to make Povlet useful and reliable, but do not promise uninterrupted, error-free service, permanent availability of every feature, or unlimited storage. Keep separate copies of photos that are important to you. Maintenance, connectivity issues, or third-party outages can affect the service.
If we introduce paid features, their prices and applicable payment, renewal, and cancellation terms will be presented before you purchase. These terms do not authorize automatic charges. Your mobile provider may charge for data used by the app.
We may change or discontinue features. Where a change materially affects existing rights or access to your content, we will provide notice and reasonable options where required by law.
Third-party services and app stores
Apple, Google, email providers, and services you choose through the share sheet operate independently of Povlet. Their own terms apply to your use of their services. We are not responsible for their conduct, but this does not limit any responsibility we have for providers processing information on our behalf.
Your app-store download may also be subject to the relevant store’s terms or standard app license. Povlet is responsible for the service and its support; an app store is not a party to your private journal or a promise of notification delivery.
The Povlet name, logo, app design, and service software are protected by applicable intellectual-property rights. You may use the app for its intended purpose, but may not misuse our branding or copy or distribute our software except as allowed by law or a separate license.
Responsibilities and legal rights
To the extent permitted by applicable law, the service is provided “as is” and “as available,” without additional warranties of uninterrupted operation, fitness for a particular purpose, or freedom from errors. We cannot guarantee another user’s behavior or recover content they have copied outside the app.
To the extent permitted by law, Povlet is not liable for indirect or consequential losses arising from use of the service. Nothing in these terms excludes or limits liability for fraud, intentional misconduct, death or personal injury caused by negligence, or any liability or consumer guarantee that applicable law does not allow us to exclude or limit.
If a dispute arises, contact us so we can try to resolve it. These terms do not require mandatory arbitration or waive your right to use courts or regulators available under applicable law, including mandatory protections in your country of residence. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
Updates and contact
We may update these terms as the service or legal requirements change. We will update the date above and give notice of material changes where required. Where a change requires your agreement, we will seek it. If you do not agree to revised terms, you may stop using the service and request deletion of your account.
Questions, support requests, and notices about these terms can be sent to Povlet at surafelpovlet@gmail.com.
